Terms of Use
These Terms govern Lembriva, a digital storytelling service operated by João Batista Lisboa Peçanha, an individual registered under Brazilian CPF 056.264.417-27. Physical address for identification and correspondence: Rua Professora Luíza Vieira, 705, Magé/RJ, Brazil. Contact: contato@lembriva.com.
Eligibility and account
Only people aged 18 or over may create or keep an account. By creating an account, you declare that you are at least 18. Lembriva may restrict or close accounts when there are reasonable grounds to believe this rule has been breached. You must provide accurate information and protect account access.
Your content and necessary permission
You retain the rights you hold to uploaded text, photos and memories. You give Lembriva a non-exclusive permission limited to providing the service to store, technically adapt, process, display and export that content; publication or sharing depends on your choice. This permission does not allow us to sell your photos or memories.
Other people, sensitive data and minors
Only include another person's information or images when you have an appropriate right or legal basis; respect their privacy and image rights. Avoid unnecessary sensitive or excessive information. When including children or teenagers, consider their best interests and avoid exposing routines, locations or details that could put them at risk. Lembriva retains its own legal obligations regardless of the uploader's responsibilities.
Artificial intelligence
AI assists in creating narratives from necessary parts of the content you provide and, depending on the feature, images. Output may contain errors, omissions or similarities to other text. Review names, facts, dates, images and permissions before sharing. We do not guarantee exclusivity or a specific result, nor limit rights protected by law.
Publication and revocation
You choose public, unlisted or private publication. Anyone can access a public story; recipients of an unlisted link can forward it; a private story requires a link and password. Revocation blocks access through Lembriva's public endpoints, but technical caches may take time to expire. We cannot recall screenshots, downloads or copies already made by third parties.
Permitted use and complaints
Do not use the service to infringe rights, post unlawful content, threaten people or compromise security. People depicted, including those without accounts, may contact us about privacy, image rights or publication. We will assess the facts and may temporarily suspend, restore or remove content as appropriate; a complaint alone does not automatically remove it. We will not disclose the author's private data to a complainant without an appropriate legal basis.
Credits and purchases
Adding people, memories and photos and preparing a story does not consume credits. When billing is enabled, each AI generation costs 5 credits; editing, publishing, sharing or exporting an existing version does not consume more. Packages, final prices, currency and bonuses are shown before purchase confirmation. There is no monthly subscription. Payment is processed by Stripe Checkout; Lembriva does not receive full card details.
Refunds and disputes
You may request a full refund within seven calendar days of payment confirmation in the Credits and purchases area of your account or by emailing contato@lembriva.com, even if some or all purchased credits have been used. An in-account request receives an immediate reference and confirmation; either channel may require manual review, and submitting a request does not automatically reverse the payment. After that period, duplicate or improper charges, fraud, serious technical failure, undelivered generation and other legally protected situations will be assessed individually. Refunds are linked to the original purchase; its credits and bonuses will be adjusted with an audit trail, without improperly removing credits from another purchase. Payment disputes will also be reviewed and reconciled. Legal rights do not depend solely on Lembriva's discretion.
Failures and availability
A technical failure preventing delivery of a usable generation should not consume credits. The service may experience interruptions or changes. We will communicate material changes to these Terms appropriately, without retroactively removing acquired rights.
Account deletion
Deletion ends access to projects, publications and remaining credits. Unused paid credits are not automatically converted to cash merely because you delete the account; bonuses have no monetary value. Request an applicable refund before or during deletion: your rights do not disappear with the account. Financial records needed for legal duties, reconciliation, fraud, disputes or legal claims may be retained for the applicable period. See the Privacy Policy for data and technical copies.
Payments and tax obligations
Payments are processed by contracted providers, currently Stripe. Lembriva remains responsible for its applicable legal and tax obligations under its classification. Where required, tax documentation will be issued or made available under the procedures of the competent authorities. Stripe's payment processing does not transfer Lembriva's own tax obligations to Stripe.
